Tribal Vision Private Membership Association — Membership Agreement (Draft v1, July 2026)

1. The Association

The Tribal Vision Private Membership Association ("the Association") is a private membership association of individuals who freely choose to associate under the rights recognized by the First and Fourteenth Amendments to the United States Constitution and the New Mexico Constitution. The Association is a separate, self-governing entity. E.A.R.T.H. is a sponsor of the Association and its gatherings; it is not the Association's parent, owner, or governing body.

2. Purpose

The Association exists to hold gatherings, ceremonies, work parties, and learning opportunities; to steward and build a permanent community gathering space on the Tres Orejas Mesa in Taos County, New Mexico; and to nurture a drug- and alcohol-free culture of community, land stewardship, music, and shared learning.

3. Voluntary Membership

I am joining the Association of my own free will, for my own benefit and the benefit of the membership. I understand that the Association's gatherings, events, land access, and programs are private activities offered to members only — not services offered to the general public — and that I participate as a member, not as a member of the public.

4. Member Rights & Benefits

Membership in good standing includes: attendance at Association gatherings and events (including the annual Tribal Vision Gathering); participation in work parties and land projects; access to member learning programs and workshops; participation in the member community space; and a voice in the life of the Association as its governance documents provide.

5. Code of Conduct

The Association is drug and alcohol free. Bringing or using poisonous or synthetic substances at any Association gathering or on Association land is forbidden. Members agree to treat the land, the elders, the children, and one another with respect and care. Violation of this code is grounds for revocation of membership without refund of dues.

6. Dues

Membership dues are annual, and are tiered by membership number. A member’s rate is set by their membership number at joining and is retained through continuous annual renewal:

• Members 1–50 (Founding Circle): $99/year
• Members 51–150: $133/year
• Members 151–300: $199/year
• Members 301–500: $222/year
• Members 501 and beyond: $333/year

Dues fund the Association’s gatherings and the Home Lands build.

7. Term, Renewal & Revocation

Membership runs for one year from acceptance and renews upon payment of annual dues. A member may resign at any time. The Association may revoke membership for violation of this agreement by decision under its governance process; dues are not refunded upon revocation for cause.

8. Privacy

Member records are kept within the Association, used for the Association's own communication and record-keeping, and are not sold or shared outside the Association except as law requires.

9. Dispute Resolution

Members agree to bring any dispute arising from membership first to good-faith mediation within the Association's governance process; if unresolved, to binding arbitration in Taos County, New Mexico, before resorting to any court, to the extent permitted by law.

Assumption of Risk & Waiver

READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS.

I understand the nature of Association activities. Gatherings and work parties take place on remote, undeveloped high-desert land on the Tres Orejas Mesa at roughly 7,000 feet elevation, a significant distance from medical facilities, with primitive camping conditions. Activities include, among other things: camping; open fires; live music and amplified sound; ceremony; hiking on uneven terrain; exposure to sun, wind, storms, heat, cold, and wildlife; and, at work parties, physical labor and natural-building construction including hand and power tools, ladders, and heavy materials.

I knowingly assume these risks. I understand these activities carry real risks — including injury, illness, property damage, and death — and I voluntarily choose to participate with full knowledge of them. I am responsible for my own health, fitness to participate, hydration, sun protection, and medical needs, and for the supervision and safety of any minor children in my care.

Waiver and release. To the fullest extent permitted by law, I release and agree not to sue the Association, its founders, organizers, volunteers, sponsors (including E.A.R.T.H.), and the owners of the land on which Association activities occur, from any claim for injury, loss, or damage arising from the ordinary negligence inherent in Association activities. I understand this waiver does not and cannot release anyone from liability for gross negligence, recklessness, or intentional misconduct, and nothing in it limits rights that by law cannot be waived.

Medical authorization. If I am injured or incapacitated at an Association activity, I authorize Association organizers to summon and consent to emergency medical care on my behalf, at my expense.

Proper Membership — Additional Terms (Draft)

Proper Membership includes all rights and benefits of regular membership, and additionally:

• Vending access at Association gatherings and events.
• A permanent spot on the land to build out a booth over the years, with the site assigned through the Association's land stewardship process.
• Voting over any major changes occurring to the gather grounds.
• Special perks such as merch and gifts from the PMA.

Proper Membership dues are annual and tiered by Proper Membership number; a member's rate is set at joining and retained through continuous annual renewal (tiers subject to change):

• Proper Members 1–10: $108/year
• Proper Members 11–20: $222/year
• Proper Members 21–30: $333/year
• Proper Members 31 and beyond: $555/year
